Any account that becomes 60 days delinquent will be turned over to an attorney for collection. Only one demand letter will be sent. If payment or arrangements to make payment have not been made with the attorney within 30 days thereafter, a suit will be filed for the delinquent fee, late charges, attorney's fee and court costs.

Clubhouse - Rental/Usage InformationRules and Regulations, Section M. Party Room (Club Room):
Parties and meetings may be held in the condominium party room on any day of the week unless the date is in conflict with a regularly scheduled Board or Homeowners Association meeting.

All private parties or meetings must be sponsored by a resident and such resident must be present at all times. The party room should be reserved by the responsible resident by noting the date and time of the reservation and the name or unit number on the calendar provided on the bulletin board in the party room.

Board Meeting InformationThe Board of Directors meet the last Wednesday of each month, and any owner is welcome to attend these meetings. The Annual Homeowner's Meeting is in November of each year to approve the budget and elect board members.

Waste/Recycling informationWaste Management comes once a week to empty the dumpster. The janitor picks up trash and garbage and carries it to the dumpster twice a week.

Rules and Regulations, Section K. Garbage:
1. All garbage must be deposited within the dumpster or else it will be the responsibility of the individual to dispose of it. Trash placed outside the dumpster will not be picked up by the garbage truck.

2. Items too large for the dumpster can be picked up by calling the Managing
Agent. There will be a fee for this service.

3. All boxes should be cut down or flattened by the resident or the janitor before placing in the dumpster.

4. All garbage must be in bags and securely tied.

5. Material such as carpeting, lumber, appliances and any scrap material from unit renovation or repairs may not be placed in the dumpster. All workmen performing work on a unit are expected to conduct the work in a good and workmanlike manner and are to be instructed by the Owner to remove all construction and/or remodeling materials from the premises when work has been completed.

Move In/Move Out InstructionsRules and Regulations, Section E. Moving In and Moving Out:

1. If the move will require the use of the association elevator, the Owner should contact the janitor or a Director of Facilities on the Tuesday or Friday prior to the move to have the protective covers placed over the elevator panels and flooring.

2. Moving hours are 8:00a.m. to 5:00p.m. Monday-Saturday. Moves are not permitted on Sunday.

3. The moving van must be parked in a manner that will allow other residents to come and go with ease.

4. The responsible party is to arrange for the removal of all boxes and debris associated with the move into or from a unit. This debris is not to be disposed of in the common area or in the dumpster.

Parking InformationRules and Regulations, Section J. Parking:

1. Parking on the Association property shall be reserved for condominium Owners, residents and guests on an availability basis. Owners should remind their guests and service staff not to park in the covered area except in the Owner's assigned space.

2. Each unit at Morningside is provided one (1) parking space in the carport, and owners are encouraged to use this space first. The designated spaces in the carport should be used as often as possible, thus leaving the unassigned spaces open for guest parking.

3. No parallel parking next to or diagonal to any curbs is allowed. Parallel parking next to the entrance of the condominium at the canopy is permissible to load and unload passengers or household items for a period of up to fifteen (15) minutes.

4. Seldom-used vehicles should not take prime parking spaces. All vehicles parked on association property must have current tags and be in operable condition.

5. Recreation vehicles, trailers and boats may not be parked on the
Association property except for the purpose of loading or unloading.

6. Maintenance and repairs on vehicles are not permitted on Association property. In the event of an emergency, a service station or other repair facility should be called.

7. No resident shall park more than two (2) autos per unit in parking lots except by permission of the Board.

8. Parking for any sizable event presents a space problem. Owners should advise guests to ride together or park in alternate places such as the post office lot (available at night).

Pet PolicyRules and Regulations, Section H. Pets:
1. Household pets may be kept by an owner in his residence, provided they are not kept, bred, or maintained for any commercial purpose and do not endanger the health or safety of another resident.

2. No unit will be allowed more than two (2) mammalian pets. In case a pet has a litter, the owner or lessee has ten (10) weeks from the date of birth to comply with this rule.

3. Dogs and cats on the common property must be on a leash or under the direct and absolute control of the Owner at all times.

4. Pet owners are directly responsible for any damage done by their pets to common areas.

5. Any owner who keeps or maintains any pet shall be deemed to have indemnified and agreed to hold the Association free and harmless of any loss, claim or liability of any kind or character whatever arising by reason of keeping or maintaining such pet within the condominium development.

6. Accidents of fecal matter by pets on the pavement, sidewalks in the common areas, landscaped areas, and lawns are to be cleaned up immediately by the Owner. The Owners must inform any of their guests who bring pets on the premises of this policy and supply them with appropriate material or equipment to clean up after any accidents.

7. The Board of Directors shall have the right to order any person whose pet is a nuisance to remove such pet from the premises upon three (3) days prior written notice.

8. All pets shall be tagged for identification and properly licensed. Pet owners must be able to provide proof of current vaccinations for any pet allowed outside.

Rental PolicyRules and Regulations, Section D. 3. Lease:
a. Owner must provide a copy of the Rules to the lessee. Copies can be obtained through the Managing Agent. If the unit is sublet, the sub-lessee must also receive copies of the document.

b. Any lease agreement must contain the following: "the terms of this lease agreement shall be subject in all respects to the provisions of the Declaration of Condominium, Bylaws and Rules and Regulations of Morningside Condominiums and any failure by Lessee to comply with terms of such documents shall constitute a default by Lessee." It is recommended for the Owner’s protection that the lease include a clause specifically stating that: "All fines levied against the Owner because of tenant rules violations shall be paid by the tenant."

c. The Managing Agent must be informed of all leases, subleases and changes in ownership and be advised of the new occupant’s name and telephone numbers. The Managing Agent will in turn advise the Board of Directors and supply a new printed list of occupants for appropriate distribution by the Board of Directors.
